in a word yes, but you may need to go to court.
As he only had 2 years warranty and didn't even take his bike to a BMW dealer for it's 4th year service HOW did he get BMW to pay for a new shock when normal owners have trouble getting help out of the 2 year warranty??

Mine went at 23,000 miles in France.
Although i bought the bike privately, i transferred the extended warranty so was covered.
In the end though the shock was replaced FOC. Not bad for 3 years old and over 20,000 miles to be fair to BMW Cotswold on my first dealing with them
